Activity

The purposes in activities:

Ensure phytosanitary control of plants, plant products and other regulated objects nationally, and also which are imported, exported and passing by transit;

Ensure control of imported, exported and supplied through market fresh fruits and vegetables in grading, packing centres and wholesale the conformity to trade standards requirements;

Ensure registration of plant protection products and implement their import, sale, storage, packaging-labelling and use control;

Perform control of genetically modified propagating material and genetically modified plants and plant products that are not intended for human food and animal feed monitoring and control in the internal market and at the border, as well as control of genetically modified risk crops;

Ensure the quality control of grains, propagating material and control of fertilizers;

Ensure plant varieties registration and their legal protection;

Within its competence to ensure the implementation of intervention measures;

Ensure quantity and quality control of food grain at state reserve;

Within its competence to participate by ensuring the safe and healthy food production chain.

PROPAGATING MATERIAL – seeds, all plant material or vegetative parts of plants intended for the propagation and production of specific variety plants.

The Service performs crop and fruit plants inspection, sampling of lots for certification and seed quality analysis through certification of propagating material. Seed Certificates, Seed Potatoes Certificates or Fruit Plant Certificates, according to plant species, are issued for lots of propagating material, which quality meets the minimum quality requirements. Certified seed lots are tested in Post – control trials for varietal identity and varietal purity determination. Service inspects propagating material supplier’s which multiplies and supplies propagating material to the market and issues Propagating Material Suppliers Certificates. Gives the authorisation to market seed of varieties for which an application for National Plant Variety Listing has been submitted. Provides training courses on certification and market control of propagating material. Collects and organizes information about certified propagating material quantity and quality, crops and fruit plants field inspection.

Plant Propagating Material Division provides methodological assistance to structural units of the Service for certification and marketing of propagating material, testing of certified seed lots in Post – control trials, inspection and maintenance of propagating material suppliers.

Propagating material certification and market control are performed by the regional divisions of State Plant Service under the Ministry of Agriculture (hereinafter - Service). Testing of certified seed lots in Post – control trials is carried out by Kaunas Regional Division.

Suppliers of propagating material for the certification of propagating material (crop and fruit plant inspection, sampling of lots for certification) shall contact the regional divisions of the Service according to their place of service. Plant Product Quality Testing Laboratory (Division) tests quality of certified seed and none certified according the requests of suppliers. Regional divisions of Kaunas, Klaipėda, Panevėžys and Šiauliai carry out seed testing only on the requests of suppliers.

Important information

Plant Protection Products Authorisation - administrative act by which State Plant Service under Ministry of Agriculture authorises the placing on the market of a plant protection product in Lithuania.

        Plant Protection Products Authorisation Division after receiving application and all data required carries out the assessment of data provided for plant protection products authorisation, i.e. evaluation of active substances and their products identity, physical chemical properties and analytical methods validation, toxicological and metabolism studies, residues in and on treated plants or plant products, fate and behaviour in the environment, ecotoxicological studies, biological efficacy.   

        Carries out risk assessment for operators, workers, bystanders and residents and for birds, mammals, aquatic organisms, soil   micro and macro organisms, non target arthropods.

        Comes to decisions for granting plant protection products authorisation, non-authorisation, re-registration, expansion and changes of uses, etc..

         Examines the applications and documents related for granting parallel trade permits, authorisations for placing on the market products for a period not exceeding 120 days, permits for scientific research and trial purposes.

         Assesses the equivalence of technical active substance.

        Coordinates activities of Good Experimental  Practice.

         Participates in the EU process of active substances assessment, expert working groups on Pesticide Risk Assessment Peer Review Process, the EU Commission Standing Committee on Food Chain and Animal Health Section: Plant Protection Products – Legislation, EFSA Pesticide Steering Committee.

Plant protection products for non professional use

The State Plant Service under the Ministry of Agriculture (thereinafter – Service) implements governmental politics on control of plant protection products (thereinafter – products) and fertilizers with regard to reduce risks to human health and environment and to ensure safety and wholesomeness of food at all stages of the food chain.

The Service issues permits for sellers to trade products and permits to import products from countries non EU members and from countries non European economic area. The Service proposes actual topics to the research work institutions; collaborates with the national and international science institutions; participates in various national and international training and qualification upgrade events, expert work groups, meetings, seminars, conferences and other events concerning control of products’ and fertilizers’ placing on the market, storage, sale, use and packaging-labelling.

 Agrochemical division (thereinafter – Division) ensures the implementation of EU and national legislation in the area of products and fertilizers supervision. The Division coordinates, gives methodological guidance, organizes trainings for Regional specialists of the Service, who carries out control on products’ and fertilizers’ placing on the market, storage, sale, use and packaging – labelling. Regional specialists enforce Administrative Code penalties and other legal sanctions for breaches; carry out inspection of farm holdings according to requirements of the Regulations on good agricultural practice and gather information on products annual sales amounts. Also, they carry out sampling of products and fertilizers and delivering them to the authorized laboratory for conformity and quality control; investigate complaints and information on the various cases of inappropriate sale, storage, use and packaging–labelling of products and fertilizers.

The Division gathers, analyzes, summarizes information on products and fertilizers control and prepares reports; prepares report to the European Commission and EU member states on products control according to EU legal acts and prepares statistical summary on products imported from countries non EU members and from countries non European economic area. The Division, in collaboration with the Division phytosanitary border control point’s phytosanitary posts, collects and organizes data on the quantities of fertilizers imported from third countries. The Division participates in the preparation of the annual products’ and fertilizers’ control plans, prepares reports on inspections relating to products and fertilizers control; carries out yearly analysis of products and fertilizers use and provides consultations on questions related to products and fertilizers. The Division also prepares proposals of draft legal acts in the areas of products and fertilizers control.

Important information

Phytosanitary is the prevention, agro-technical and organizational measures, that ensures plant health. Therefore, phytosanitary is important for the crop producing industry’s further development as it is especially significant branch of Agriculture. Moreover, Lithuania is a bridge between Western and Eastern Europe, and it is used for international trade in an unbroken chain. Therefore tremendous efforts are necessary to avoid an introduction of harmful organisms to plants and plant products in to the territory of the Republic of Lithuania and the European Union and to limit any spread.

Specific prevention, agro-technical and organizational measures are based on the legal level in line with International Plant Protection Convention. The most important regulation in this field of Phytosanitary is the Law on Phytosanitary of the Republic of Lithuania. One of the most important preventative measures to minimize risk of introduction of harmful organisms is the control of import of plants, plant products and other objects from non-European Union countries, therefore plants, plant products and other objects may be imported only through those border control points, which have phytosanitary inspection posts. Currently operates eight such posts, where inspectors of the State Plant Service under the Ministry of Agriculture (SPS) work 24 hours. Duties of inspectors are to control consignments of plants, plant products and other objects, but also the non plant origin consignment where wood packaging material is used, because it can be a magnificent environment for harmful organisms to travel long distances too.

Staff of Phytosanitary border inspection posts also control transit condition of the consignments and verify possible risk of introduction of harmful organisms into the territory of Lithuania.

We would like to state, that when we spoke about harmful organisms, we mean not only with naked eye visible organisms (for instance – insects), but also micro-organisms (nematodes, fungi, bacteria, viruses).

It is very important to know phytosanitary status of the country, therefore Phytosanitary division has obligation to organize surveillance for certain harmful organisms. Surveillance is performed annually in certain agricultural crops, orchards, nurseries, parks and forests, in order to identify harmful organisms. To prevent possible spread inside the country, there are regularly monitored market pleases of plants, plant products and related objects. Surveillance, including sampling of plants, their growth medium, water (used for irrigation) and plant products for analysis and public consultations about plant health, are taken by SPS regional offices, which are founded in the centers of counties, inspectors. Those inspectors also are responsible for export control of plants, plant products and other objects from Lithuania to the non-European Union countries, in line with phytosanitary requirements of importing country.

The case of finding of harmful organism lead to phytosanitary measures which are usually very expensive, therefore the identification harmful organism is the key factor for justification of requested measures; therefore samples are tested by experts in well equipped phytosanitary diagnostic laboratory in line with scientific data.

Phytosanitary Division, is in charge of implementation of the state policy to improve plant health in Lithuania, providing methodological management to SPS regional offices in mentioned above cases. In harmful organisms’ detection cases, Phytosanitary Division prepares contingency plans to eradicate harmful organisms, or to contain the spread, and coordinates its implementation.

Moreover, staff of Phytosanitary Division is involved in international activities in the field of plant health. One of the tasks of Phytosanitary Divisions is preparation of information about surveillance, detected outbreaks of harmful organisms, implementation of phytosanitary measures, for the institutions of European Union and International organizations. We would like to stress, that this is not the only function of Phytosanitary Division, experts are consistently implementing a plenty of other activities.

    Important information

    In the implementation of plant health control and other activities, the Phytosanitary Research Laboratory (Division, hereinafter referred to as the Phytosanitary Research Laboratory)  performs its duty as an Official Laboratory  and National Reference Laboratory  and undertakes other duties related to various plant pests: bacteria, mites, phytoplasmas, fungi and oomycetes, molluscs, nematodes, insects, viruses, and viroids. Also, the Phytosanitary Research Laboratory (Division) engages in the detection, identification, and confirmation of weed seeds in plants, plant products, and other related objects.

    The main research areas of the Phytosanitary Research Laboratory are as follows:

    The Phytosanitary Research Laboratory determines quarantine pests, regulated non-quarantine pests and other plant pests relevant to the importing country in plants, plant products and other related objects. The Phytosanitary Research Laboratory handles the preparation and implementation of sampling techniques, their methodologies of transportation and storage, and diagnostic procedures as well as the organization of relevant and periodic trainings for specialists of the State Plant Service under the Ministry of Agriculture (hereinafter referred to as the State Plant Service).

    Accreditation

    The Phytosanitary Research Laboratory has been accredited for compliance with the LST EN ISO / IEC 17025: 2005 standard since 2015. The laboratory was re-accredited for a new 5-year period on November 11, 2020.Certificate No. LA.01.153 issued by the National Accreditation Bureau certifies that the Phytosanitary Research Laboratory complies with the requirements of the LST EN ISO / IEC 17025: 2018 standard and is accredited to perform tests of plants, plant products and their pests.

    Samples for the detection of plant pests  are taken by specialists of regional divisions and Phytosanitary posts (divisions) of border control of the State Plant Service in accordance with the sampling methods that are  approved by legal acts and are appropriate for the target pest.     The rapid agricultural development in Lithuania would not be possible without creating and using new and advanced plant varieties. The Plant Varieties Division is responsible for the registration of plant varieties – their entry in the National List of Plant Varieties and for the protection of plant varieties as breeders' intellectual property products in the Republic of Lithuania.

    The Plant Variety Division specialists examine and register the breeder’s applications for the Plant Variety Listing into the National List of Plant Varieties or for Plant Variety Protection in the Republic of Lithuania, organize the performance of mandatory testing for distinctness, uniformity and stability in the competent European Union Member States institutions as well as tests for value for cultivation and use, and check the proposed plant variety denominations. Tests for Cultivation and Use are carried out in five Plant Varieties Testing Divisions of the Plant Service located in different Lithuanian soil and climatic zones. During these tests the variety harvest, the quality of the grown production, the variety resistance to adverse growing conditions and other characteristics are assessed. The aim is that the National List of Plant Varieties should contain only high quality, well adapted to the Lithuanian conditions varieties of plants, and this list could serve farmers and other seed users' interests. Every year over 450 varieties of agricultural plant species are tested. The data of Cultivation and Use testing are analyzed, summarized and submitted to the plant breeders and the State Board for Plant Varieties Evaluation with the aim of registering new plant varieties. Interested users can find plant variety descriptions and each year data for value for cultivation and use in the State Plant Service under the Ministry of Agriculture of the Republic of Lithuania website www.vatzum.lt. Information Bulletins for Plant Breeders’ Rights and the National List of Plant Varieties issued twice a year are published in this website as well.

    Legal Protection could be granted to varieties of all plant species in the Republic of Lithuania.

    The Division specialists participate at the meetings of the International Union for the Protection of New Varieties of Plants (UPOV), the Administrative Council of the Community Plant Variety Office (CPVO) and at the meetings with examination offices, the European Commission, the European Council working group and provide these institutions with all the required information.

    Border control coordination division organizes, coordinates, and controls the activities of phytosanitary posts (departments) of border control points related to:

    • control of the phytosanitary status of the import of plants, plant products and objects related to them into the Republic of Lithuania and the EU and transit transportation;
    • control of compliance of wooden packaging materials imported from third countries with established phytosanitary requirements;
    • border control of genetically modified plants and plant products and propagating material not intended for human food and animal feed, imported into the Republic of Lithuania and the EU and transported in transit, as well as border monitoring of consignments of plants, plant products and propagating material that could contain genetically modified organisms;
    • border control of invasive alien plant species in order to ensure the 2014 October 22 European Parliament and Council Regulation (EU) No. 1143/2014 on the prevention and management of the introduction and spread of invasive alien species (OJ 2014 L 317, p. 35), the implementation of Article 15, paragraph 2;
    • control of compliance with trade standards of imported fresh fruits and vegetables;
    • control of plant protection products imported into the Republic of Lithuania from countries outside the EU and outside the European Economic Area and transported in transit;
    • checking the requirements of imported fertilizing products;
    • issuing plant passports for imported plants, plant products or other objects.
